1. Services Overview
NeonGhost provides website development and hosting services as described below. All Services are subject to these T&Cs and any additional terms specified at the time of purchase.
Neon Starter ($50 USD)
Argon Links ($50 USD)
Krypton Custom Website (Starting at $200 USD)
Nitro E-commerce Website (Starting at $580 USD)
2. Revisions
Included Revisions: Neon Starter and Argon Links include one (1) revision; Krypton Custom Website and Nitro E-commerce Website include two (2) revisions. A revision includes changes to design, content, or functionality (e.g., text edits, color adjustments, image swaps) as specified in the service description.
Additional Revisions: Additional revisions beyond those included are available at an extra cost, quoted at Neon Ghost’s discretion (e.g., $25+ per revision for Neon Starter/Argon Links, $50+ for Krypton/Nitro, depending on complexity). Clients must request additional revisions in writing within 14 days of receiving the initial deliverable.
Scope of Revisions: Revisions do not include major changes to the website’s structure, functionality, or purpose after the initial design is approved. Such changes may require a new project quote.
3. Content Restrictions
Prohibited Content: NeonGhost strictly prohibits the use of our Services for websites containing illegal, pornographic, obscene, defamatory, discriminatory, or otherwise offensive material, including but not limited to:
Content violating local, national, or international laws.
Adult or pornographic content.
Content promoting hate, violence, or discrimination.
Content infringing on intellectual property rights.
Right to Refuse: Neon Ghost reserves the right to refuse or terminate Services if a client’s content violates these restrictions or our ethical standards, with no refund provided for non-compliant projects.
Client Responsibility: Clients are solely responsible for ensuring their content complies with applicable laws and these T&Cs. Neon Ghost is not liable for any legal issues arising from client-provided content.
4. Client Responsibilities
Content Submission: Clients must provide all necessary materials (e.g., images, videos, text, branding guidelines, links) in a timely manner to meet delivery timelines. For Neon Starter and Argon Links, materials must be submitted within 7 days of purchase to ensure 24-hour delivery. Delays in submission may extend delivery timelines.
Accuracy: Clients are responsible for the accuracy, copyright and legality of all provided content. Neon Ghost is not responsible for errors in client-submitted materials.
Access and Approvals: For Krypton Custom Website and Nitro E-commerce Website, clients must provide access to domain registrars or third-party services (e.g., payment gateways) as needed for setup. Clients must review and approve deliverables within 14 days of receipt.
5. Payment Terms
Payment Schedule:
Neon Starter and Argon Links: Full payment ($50 USD each) is due upfront before work begins.
Krypton Custom Website and Nitro E-commerce Website: A 50% deposit is due upfront, with the remaining balance due upon project completion and before the website is launched. Custom quotes will specify payment terms.
Payment Methods: Payments are accepted via methods specified at checkout (e.g., credit card, PayPal, cryptocurrency for Nitro E-commerce). Clients are responsible for any transaction fees.
Late Payments: For Krypton and Nitro packages, if the final payment is not received within 7 days of project completion, Neon Ghost may suspend hosting or withhold website access until payment is made.
Additional Costs: Extra revisions, add-ons, or third-party fees (e.g., domain registration, premium plugins) are quoted separately and due upon approval.
6. Hosting and Domains
Free Hosting:
Neon Starter and Argon Links include free hosting* on a subdomain (e.g., neonghost.net/yourname).
Krypton Custom Website and Nitro E-commerce Website include one (1) year of free hosting, after which clients may continue hosting with Neon Ghost at a quoted rate (e.g., $50/year) or transfer to another provider.
Custom Domains:
Krypton and Nitro packages include setup for a custom domain (e.g., yourname.com). Clients are responsible for purchasing and renewing the domain through a registrar (e.g., GoDaddy, Namecheap).
Neon Starter and Argon Links offer custom domain setup for an additional one-time fee (e.g., $20), quoted at purchase.
*Free hosting on a subdomain (e.g., neonghost.net/yourname) is provided for as long as Neon Ghost remains online and operational. If Neon Ghost ceases operations or goes offline, hosting and subdomain availability will terminate, and Neon Ghost is not obligated to maintain or fund the domain or hosting thereafter.
7. Delivery and Timelines
Neon Starter and Argon Links: Delivery within 24 hours of receiving complete client materials, provided materials are submitted within 7 days of purchase.
Krypton Custom Website and Nitro E-commerce Website: Delivery timelines are provided in the custom quote (typically 7–14 days for Krypton, 14–21 days for Nitro). Delays in client feedback or materials may extend timelines.
Force Majeure: Neon Ghost is not liable for delays due to unforeseen circumstances (e.g., server outages, natural disasters).
8. Refunds and Cancellations
Non-Refundable Payments: Due to the custom nature of our Services, all payments are non-refundable.
Cancellations:
Clients may cancel a project before work begins by notifying Neon Ghost in writing. For Krypton and Nitro, any deposit paid is non-refundable if work has started.
If a client cancels after work begins, Neon Ghost may deliver partial work completed (e.g., design drafts) at our discretion, with no further obligation.
Non-Delivery: If Neon Ghost fails to deliver the agreed-upon Services due to our fault, a partial or full refund may be offered at our discretion, excluding third-party fees.
9. Intellectual Property
Client Content: Clients retain ownership of all content they provide (e.g., images, text, logos). By submitting content, clients grant Neon Ghost a non-exclusive, worldwide license to use, modify, and display the content for the purpose of delivering the Services.
Website Design: Upon full payment, Neon Ghost grants the client a non-exclusive license to use the website design and code for its intended purpose. Neon Ghost retains ownership of proprietary tools, templates, or AI-generated elements used in development.
Portfolio Rights: Neon Ghost may showcase completed websites in our portfolio or marketing materials, unless the client requests otherwise in writing at the time of purchase.
10. Limitation of Liability
Service Guarantee: Neon Ghost strives to deliver high-quality Services but does not guarantee specific outcomes (e.g., search engine rankings, sales, or website performance) due to factors beyond our control.
Liability Cap: Neon Ghost’s liability for any claim related to the Services is limited to the amount paid by the client for the specific Service. We are not liable for indirect, incidental, or consequential damages (e.g., lost profits, data loss).
Third-Party Services: Neon Ghost is not responsible for issues arising from third-party services (e.g., domain registrars, payment gateways, hosting providers after the free period).
11. Termination
By Neon Ghost: We may terminate Services or hosting immediately if a client violates these T&Cs (e.g., prohibited content, non-payment) or engages in abusive behavior. No refunds will be provided.
By Client: Clients may terminate Services by providing written notice before work begins. After work starts, cancellation terms in Section 8 apply.
Post-Termination: Upon termination, Neon Ghost may suspend hosting and website access. Clients must transfer domains or hosting within 30 days, or risk loss of access.
12. Additional Terms
Client Conduct: Clients agree to communicate respectfully and provide feedback constructively. Abusive or harassing behavior may result in termination of Services without refund.
Third-Party Fees: Clients are responsible for any third-party costs not explicitly included (e.g., domain registration, premium plugins, or payment gateway fees).
Website Maintenance: Neon Ghost does not provide ongoing maintenance unless quoted separately. Clients are responsible for updating content or software after delivery, unless a maintenance plan is purchased.
Service Modifications: Neon Ghost reserves the right to modify Service features, pricing, or T&Cs at any time. Existing clients will be notified of changes affecting their projects.
Data Privacy: Client data is handled in accordance with our Privacy Policy [link to your privacy policy, or create one if needed]. Neon Ghost does not share client data with third parties except as required to deliver Services (e.g., hosting providers).
